Legal Definition of Burglary Understanding the Charges

Burglary charges differ from theft and robbery in many important ways. This legal definition of burglary will help clarify the charges you're facing as well as the legal ramifications.

What Is Burglary?

Theft means taking someone else's property. Robbery means taking property from someone by force. In contrast, burglary specifically refers to unlawfully entering a structure with the intent of committing a crime. This crime does not need to involve theft or robbery, and force may not be needed to enter a structure.

Possession of Burglary Tools

In addition to the unlawful entry into a structure, it is also possible to be charged with the possession of burglary tools. This criminal charge refers to the possession of any devices or instruments that assist in the unlawful entry into a structure. It is classified as a Class 5 felony.

Colorado has different classifications for burglary based on the nature of what transpired. First degree burglary is the most serious of these criminal charges.

First Degree Burglary

A person is charged with first degree burglary if they assaulted, menaced, or threatened physical violence against someone after they unlawfully entered a structure. The use or threatened use of deadly weapons applies in these cases.

Second Degree Burglary

A person is charged with second degree burglary if they unlawfully entered a structure with the intent of committing a crime. Note that the intended crime need not be committed in order to be charged with second degree burglary.

Third Degree Burglary

A person is charged with third degree burglary if they unlawfully breached equipment or locked containers such as vending machines, cash registers, vaults, and ATMs. A structure or dwelling does not need to be breached in these cases.

I called Dadvocates to find legal advice about a particular sensitive situation I was dealing with. I don't typically like calling law firms because I find they provide minimal advice while running up my tab. But in this case, Jason and Kaitlyn really helped me out. They gave me a free consult and I got all the answers I needed at the time. These two attorneys are very professional, and I really believe they have their clients' best interests in mind.

Don’t waste your time looking for anyone else. Kaitlyn is a powerhouse. She is one of those few people that when you leave her you are inspired to do great things yourself. She is so impressive in what she does, but also has a way of supporting and uplifting you without a thought. It is just in her nature to take care of people and this is true both personally and professionally. She’s brilliant and fights for her clients like a bulldog. She consistently wows not only her clients, but judges, opposing counsel, and anyone paying attention. I think it’s because it doesn’t matter how large or small the case, she gives everything she has as if she’s defending her own family. That comes across clearly to anyone in the room. I'm telling you, if you choose Dadvocates you’ll look back and say that was the best decision you could’ve made for yourself.
