We Come Highly Recommended
I called Dadvocates to find legal advice about a particular sensitive situation I was dealing with. I don't typically like calling law firms because I find they provide minimal advice while running up my tab. But in this case, Jason and Kaitlyn really helped me out... These two attorneys are very professional and I really believe they have their clients' best interest in mind. Joey Hoisescu - 5-Star Google Review - 2020
Weapons Charges Defense Strategies
You didn't know you had the weapon.
In Colorado, it is illegal to "knowingly" possess a dangerous or illegal weapon. There are plenty of circumstances in which a defendant may have been found with a firearm, knife, or other weapon they didn't know they had. For example, a family member or roommate may have left a weapon in a defendant's bag or car. If this describes your situation, our lawyers will help you construct a convincing case. (Note that "knowingly" possessing a firearm refers to knowing it is in your possession; it does not refer to knowing whether or not possessing the firearm is illegal.)
The weapon was found during illegal conduct by law enforcement.
Every citizen in Colorado has constitutional rights that protect them from unlawful search and seizure. If law enforcement discovers a firearm or some other weapon in your possession during an unwarranted search of your home, an illegal traffic stop, or a mishandled arrest, there is a chance our attorneys can have your entire case thrown out. When we begin investigating any criminal charges, we always pay special attention to the conduct of law enforcement to find any instances of unlawful or inappropriate conduct.
You were permitted to have the weapon.
It may be that you have proper permits for possessing your firearm or other weapon, in which case any misdemeanor or felony charges would be ungrounded. Our lawyers can help you file the right paperwork and navigate the complex legal system to ensure that a mistaken weapons charge has no effect on your criminal record.

Common Weapons Charges Explained
Possessing a Dangerous Weapon
A "dangerous weapon" refers to a "firearm silencer, machine gun, short shotgun, short rifle, or ballistic knife." Possessing a dangerous weapon is a class 5 felony, punishable by up to three years in prison and a fine of up to $100,000. Previous offenders in possession of a dangerous weapon face a class 4 felony, punishable by up to six years in prison and a fine of up to $500,000.

Possessing an Illegal Weapon
An "illegal weapon" refers to a "blackjack, a gas gun, or metallic knuckles."
Possessing an illegal weapon is a class 1 misdemeanor, punishable by up to 18 months in jail and a fine of up to $5,000.
Legal Citation: C.R.S. 18-12-102
Carrying a Concealed Weapon
Carrying a concealed firearm or knife "about your person" without proper permits is a class 2 misdemeanor, punishable by up to one year in jail or a fine of up to $1,000. In legal terms, "concealed" means that the weapon cannot be seen "by ordinary observation," while "about the person" means that the weapon is close enough for immediate use.
Legal Citation: C.R.S. 18-12-105
Unlawful Purchase of a Firearm
There are multiple licensing and registration requirements a vendor must meet in order to legally buy and sell firearms. Additionally, it is illegal to purchase a firearm with the intent of giving it to a person who is not legally permitted to have it. Doing so is considered a class 4 felony, punishable by up to six years in prison and a fine of up to $500,000.
Legal Citation: C.R.S. 18-12-111
The Stakes Are High
Weapons and Other Criminal Charges
The possession of a weapon can have major implications on other types of criminal cases. For example, in crimes like assault or robbery, the involvement of a weapon can escalate those charges from misdemeanors to felonies.
Also, if you are already a convicted felon and you are found with an illegal firearm, the penalties you face are significantly higher.
