In addition to the unlawful entry into a structure, it is also possible to be charged with the possession of burglary tools. This criminal charge refers to the possession of any devices or instruments that assist in the unlawful entry into a structure. It is classified as a Class 5 felony.

Degrees of Burglary in the State of Colorado

Colorado has different classifications for burglary based on the nature of what transpired. First degree burglary is the most serious of these criminal charges.

First Degree Burglary

A person is charged with first degree burglary if they assaulted, menaced, or threatened physical violence against someone after they unlawfully entered a structure. The use or threatened use of deadly weapons applies in these cases.

Second Degree Burglary

A person is charged with second degree burglary if they unlawfully entered a structure with the intent of committing a crime. Note that the intended crime need not be committed in order to be charged with second degree burglary.

Third Degree Burglary

A person is charged with third degree burglary if they unlawfully breached equipment or locked containers such as vending machines, cash registers, vaults, and ATMs. A structure or dwelling does not need to be breached in these cases.

First Degree Burglary Penalties

A Class 3 felony, people charged with first degree burglary face up to 12 years in prison and fines up to $750,000. The charge becomes a Class 2 felony if controlled substances are involved.

A Class 4 felony, people charged with second degree burglary face up to 6 years in prison and fines up to $500,000. It becomes a Class 3 felony if it involves controlled substances or someone's dwelling.

A Class 5 felony, people charged with third degree burglary face up to 3 years in prison and fines up to $100,000. The charge becomes a Class 4 felony if controlled substances are involved.
